Foster parents are often advised by CPS that they cannot intervene into a court proceeding unless they have had the child in their home for 12 months. This is inaccurate. The Fort Worth Court of Appeals, Second District, held in a recent decision that foster parents do not have to wait 12 months to become a party to a lawsuit. Many foster parents will try to obtain custody of their foster children only to have Child Protective Services (CPS) tell them that they are forbidden to do so. This is simply not true. It is the court, not CPS, who makes the ultimate custody determination.
